SK-1 (Certain Retired

International Organization Employee)

 

An SK-1 immigrant is a retired officer or employee of a foreign government recognized de jure by the United States. The foreign government must be a member of an international organization entitled to enjoy privileges, exemptions and immunities as an international organization under the International Organizations Immunities Act.

 

This EB-4 category requires an SK-1 immigrant to maintain his or her status as a G-4 nonimmigrant, while residing and being physically present in the United States for periods totaling at least one-half of the seven years before the date of the visa application or for adjustment of status (AOS) to an SK-1 status for a period or periods aggregating at least fifteen years before the date of the officer or employee's retirement from the international organization.

 

Additionally, a petition for status as such an officer or employee, must be filed no later than six months after the date of such retirement or six months after the date of enactment of the Immigration and Nationality Technical Corrections Act of 1994, whichever comes later.
