EB-5 (5th Preference

Employment Creation Investors)

An EB-5 immigrant is qualified to immigrate based on investment. A large part of this preference category requires the ability to create full-time employment for at least ten authorized employees. The amount required for investment in high employment areas is $1,000,000. Only $500,000 is needed in targeted employment areas, which include rural areas designated by certain government agencies that are experiencing an average unemployment of at least 150% of the national average.

Investment immigrants must contribute funds to the business by drawing from personally owned assets. Furthermore, management responsibilities are those of the immigrant investor either through daily control or as a corporate officer, director or partner. Lastly, multiple investors may also enjoy the benefits of the EB-5 preference. Commencing such an immigrant petition simply requires a self-petition to the Immigration and Naturalization Service.
