EB-1 (1st Preference Priority Workers)

 

To be eligible for the first preference employment-based immigrant category, the individual must possess extraordinary ability in the sciences, arts, education, business or athletics. Furthermore, outstanding professors, researchers and certain multinational executives and managers qualify under this category.

 

Few people are eligible under the "extraordinary ability" qualification simply because the standard is set exceptionally high, i.e., one who has been awarded with the Nobel Prize. Since so few people fail to meet the "extraordinary ability" classification, the Immigration and Naturalization Act has provided other comparable evidence that is admissible to prove a prospective immigrant's eligibility.

 

Notwithstanding the extremely tenuous probability of being granted the EB-1 first preference, the benefit of filing such a petition includes bypassing the labor certification process. Moreover, individuals meeting the "extraordinary ability" preference are authorized to petition on behalf of himself or herself. However, an employer is required to petition for an outstanding professor, researcher and multinational executive or manager.
